We may offer a mobile messaging service (the “Mobile Messaging”) which is subject to this privacy policy and the Terms of Use. By opting in to or participating in our Mobile Messaging, you accept and agree to this privacy policy and the Terms of Use, including, without limitation, your agreement to resolve any disputes with us through arbitration as detailed in the Terms of Use.  

Through your use of Mobile Messaging, we will receive Personal Information through our third-party service provider. “Personal Information” includes information that individually identifies you, such as the mobile phone number you provided when signing up for Mobile Messaging, any username that you select in connection with the Mobile Messaging, or any information that you include in messages you send through Mobile Messaging. When you send messages via Mobile Messaging, we will also collect your messaging history and any information included in those messages.

We may also collect Personal Information about you using Cookies or similar technologies.  These Cookies enable personalization of your experience on Mobile Messaging (e.g., sending you personalized text messages such as shopping cart reminders).

If you participate in an email survey associated with Mobile Messaging, we may collect Personal Information and any other information you choose to provide in connection with such survey.

WE DO NOT SELL, RENT, LOAN, TRADE, LEASE, OR OTHERWISE TRANSFER FOR PROFIT ANY PHONE NUMBERS OR CUSTOMER INFORMATION COLLECTED THROUGH THE PROGRAM TO ANY THIRD PARTY. Nonetheless, we reserve the right at all times to disclose any Information in connection with a legal, regulation or governmental request, to avoid liability, or to protect our rights or property. When you complete forms online or otherwise provide us with Information in connection with Mobile Messaging, you agree to provide accurate, complete, and true information. You agree not to use a false or misleading name or a name that you are not authorized to use. If in our sole discretion, we believe that any such Information is untrue, inaccurate, or incomplete, or you have opted into Mobile Messaging for an inappropriate purpose, we may refuse you access to Mobile Messaging and pursue any appropriate legal remedies.

Opt-In and Opt-Out

You can opt-in to SMS/MMS mobile messages by affirmatively opting into Mobile Messaging, such as through online or application-based enrollment forms or via text message (“Opt-In”). By participating in Mobile Messaging, you agree to receive autodialed or prerecorded marketing mobile messages at the phone number associated with your Opt-In.  You understand that consent to the Mobile Messaging is not required to make any purchase from us.  While you consent to receive messages sent using an autodialer, the foregoing shall not be interpreted to suggest or imply that any or all of our mobile messages are sent using an automatic telephone dialing system (“ATDS” or “autodialer”).  Message and data rates may apply. 

If you do not wish to continue receiving messages via Mobile Messaging, you can reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any mobile message from us in order to opt out of Mobile Messaging (“Opt-Out”).  You may receive an additional mobile message confirming your decision to Opt-Out. You understand and agree that the foregoing options are the only reasonable methods to Opt-Out.  You also understand and agree that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of our employees to remove you from our list, will not constitute an Opt-Out.

Payment Processing

When you place an order through our Website, Buchart Colbert will use a third-party payment processor (our “Processor”) to facilitate your payment. We do not collect or store your payment information including your debit or credit card numbers, expiration date, or other sensitive information. Third-Party Use of Tracking Technologies

We do not control any third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

Marketing Emails from Buchart Colbert. Buchart Colbert may send you emails on occasion which provide details about products, featured content on the Website, discounts, sales, or other promotions. You may opt out of receiving these messages at any time by emailing us at info@buchartcolbert.com or by clicking “UNSUBSCRIBE” at the bottom of any marketing email you receive. Please note that your opt-out does not apply to other correspondence you receive from us such as a purchase receipt or shipping confirmation.

We do not control third parties' collection or use of your information to serve interest-based advertising. These third parties, however, may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website.

Your Nevada Privacy Rights 

Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request to info@buchartcolbert.com. Please note, however, we do not currently sell data triggering that statute's opt-out requirements.

Data Security

We have implemented physical, electronic, and managerial procedures designed to secure your information from accidental loss and from unauthorized access, use, alteration, and disclosure.

Unfortunately, the transmission of information via the internet cannot be guaranteed to be 100% secure or free of error. Although we do our best to protect your personal information, there are security and privacy limitations of the Internet which are beyond our control. Accordingly, any transmission of personal information is at your own risk. 

Children Under the Age of 13

Our Website is not intended for children under 13 years of age. Accordingly, we do not knowingly collect personal information from children under 13. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information.

European Economic Area

Our Company’s services, including our Website, are not targeted towards any customer located in the European Economic Area (“EEA”), and as such, is not subject to EU data protection law. By using our Website, any customer located in the EEA, consents to have their personal information transferred, processed, and stored in the United States, and understands and consents to the collection and use of their personal information in accordance with the terms of this privacy policy.
